A German Court Just Ruled Meta Liable for Scam Ads Its Algorithms Auction Onto Your Feed
Frankfurt Regional Court case 2-06 O 234/25, dated 16 September 2026, held Meta liable for fake Finanzfluss ads on Facebook and Instagram. Finanzfluss reported nearly 260 violations in August 2024. Damages are not yet fixed.

TechStartups (Daniel Levi, 17 September 2026) and The Next Web reported that the Frankfurt Regional Court held Meta liable for fraudulent third-party ads on Facebook and Instagram. The ads used Finanzfluss branding and co-founder Thomas Kehl's image to push fake investment offers.
This is a first-instance civil ruling dated 16 September 2026, case 2-06 O 234/25. It is not a final appellate judgment, not a US case, and not a European Commission Digital Services Act fine.
The court ordered Meta to stop the offending ads and to provide information about the ads and the revenue they generated. The damages amount has not been fixed yet. Finanzfluss reported nearly 260 violations to Meta in August 2024 alone, the court said.
Meta argued it could rely on Digital Services Act hosting protections for lack of knowledge of illegal material. The court rejected that for ads. Meta decides when and in what order ads appear, uses algorithms to distribute content, and runs an automated advertising auction, so it is not a passive chronological host.
The court cited a June European Court of Justice ruling in its reasoning. Reuters quoted a Meta spokesperson: "We respectfully disagree with this decision and are considering next steps." Meta says it detects and removes reported scam content with AI, advertiser verification, and facial recognition.
This German civil case is a separate matter from Meta's US states youth-safety settlement and from Meta AI's invasive kid prompts. DSA status questions sit next to the Commission's ChatGPT VLOSE designation.
Brand counsel and ad-ops leads selling into Germany should treat Facebook and Instagram paid placements that borrow a third-party face or logo as a live liability surface this week, and should pull campaign IDs and revenue logs now, before any damages hearing.
